Report highlights need for hospital emergency cover for children

A federal appeals court Wednesday upheld a ban on hospital emergency cover for children under the age of 5.

The district court ordered hospital emergency cover for children under the age of 5 to remain in place until the U.S. Court of Appeals for the District of Columbia Circuit rules on the case.

U.S. District Judge Tanya Chutkan said the hospital emergency cover policy was unnecessary and infringed on patients’ constitutional rights and that it was also likely to lead to an increase in hospital stays for children under the age of 5.

“If the court is inclined to hold emergency cover unconstitutional, the court should decide whether the policy is unconstitutional,” she wrote.

In April, U.S. District Judge William H. Alsup ruled in favor of Kaiser Permanente in two cases challenging the hospital emergency coverage policy. In April, U.S. District Judge William H. The hospital emergency policy covers children ages 5 and above because a federal law requires hospitals to pay for the cost of adult services for children under the age of 18. A hospital could pay to cover child care expenses from an in-patient bed to the care of an outpatient unit of care for children under the age of 18 who are unable to afford in-patient treatment, an alternative means of child-free care, an individual’s inability to pay for care and a nonemergency situation.

The hospital emergency policy is currently in place at Kaiser Permanente at the Health Sciences Center of Atlanta and Kaiser Family Foundation in Minneapolis.

Chutkan also wrote that the hospital emergency cover policy does not require the hospital to provide services for children under the age of 18 and does not place an undue burden on individuals to be screened, treated or confined by a hospital.
